By accessing or using voyatlas.com or voyatlas.io (collectively, "Voyatlas," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, you must not use our websites.
Current Aggregator Model: Voyatlas currently provides an aggregator platform displaying nature tours and related experiences offered by third-party providers ("Third-Party Providers"). Bookings are completed on external websites under those providers' own terms.
Future Direct Bookings: We may introduce direct/internal bookings hosted within Voyatlas. In that event, these Terms will also govern direct bookings, along with any additional or updated policies we make available.
You warrant that:
External Links: Currently, when you select a tour, you leave our site and book through the Third-Party Provider's platform.
Provider Terms: Your transactions and any issues (cancellations, refunds, disputes) are governed by the Third-Party Provider's terms, conditions, and policies.
No Liability: Voyatlas is not liable for, and does not warrant, any aspect of these third-party offerings.
Applicability: If and when Voyatlas introduces internal booking services, these Terms will govern your direct transactions with us, in addition to any specific booking terms or payment policies we implement.
Additional Policies: We may provide additional or updated cancellation, refund, and dispute policies for direct bookings. You agree to review and accept those policies before confirming any future direct booking.
Registration: You may need an account to access certain features. You must provide accurate and complete information.
Security: You are responsible for safeguarding your account login details and for all activity under your account.
Suspension or Termination: We may suspend or terminate your account for any violation of these Terms or other applicable policies.
When using Voyatlas, you agree:
Voyatlas Content: Text, images, designs, or code on our platform are our property or used under license. You must not use them without permission.
User Submissions: By submitting any feedback, reviews, or other content, you grant Voyatlas a worldwide, non-exclusive license to use and display that content in connection with our services.
As Is: Voyatlas is provided "as is" and "as available," without warranties of any kind.
No Endorsement: We do not endorse or guarantee the quality, safety, or legality of third-party or future direct booking services, other than what is explicitly stated.
To the fullest extent permitted by law:
Indirect Damages: Voyatlas is not liable for indirect, incidental, or consequential damages (e.g., loss of data or profits).
Aggregate Liability: Our maximum liability shall not exceed amounts (if any) you paid directly to Voyatlas for accessing or using our services in the 12 months preceding any claim.
You agree to indemnify and hold harmless Voyatlas from any claims or damages arising from your breach of these Terms, or your misuse of our services or third-party offerings.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in Ontario, unless mutually agreed otherwise.
We may update these Terms from time to time. Any changes will be posted with an updated "Effective Date." Your continued use of our website after changes are posted indicates acceptance of the modified Terms.
We reserve the right to suspend or terminate your access to Voyatlas at any time, with or without cause or notice.
